As you know, last year we had H.R. 5575: Domestic Minor Sex Trafficking
Deterrence and Victims Support Act of 2010; however, it did not make the
President's desk for his signature and/or enactment into law.

The Senate has reintroduced the bill as S. 596 and the House has yet to
reintroduce their version, therefore, I do and herein respectfully request
further review and due diligent consideration for the purpose of fast-tracking
said same if possible.

I have also attached the Sexually Oriented Business purposed bill from the State
of Texas for review and consideration as well and with all due respect regarding
possible federal enactment of regulations nationwide.

             We are in full support of H.B. 1929, Adult Entertainment Human Trafficking Bill and are indeed currently forwarding copies of said same to other honorable legislators across the entire country for their review and due diligent consideration.

            The following section therein, Sec. 2158.105(a)(2) refers to a “department-approved training course” and therefore we are most respectfully asking and/or requesting additional information regarding said same i.e., training course material, existing or proposed programs including other related information to provide further recommendations applicable within the adult entertainment industry nationwide as new regulations are enacted and require training.

ALCOHOL, DRUGS, SEX & GUNS – CORPORATE POLITICS IN AMERICA

The recipe for campaign finance strategies to ensure stakeholder’s business interests are increasingly profitable, while cooking the books to reduce costs and eliminate tax liabilities, workers compensation and other such expenses.

To stir-up the pot a little, add a fifth each of Jack Daniels, Jim Beam, Johnnie Walker, Jose Cuervo and Bacardi 151.  Mix well and serve with or without ice.

While serving the drinks add a pinch, smidgen or dash of narcotics according to personal taste and distribute freely.

As bipartisan parties, lobbyists and associates comingle with groomed sex-workers, campaign finance managers, human resource agents and armed security bouncers collect personal guarantees, promises, contributions and other such collateral to ensure that all stakeholder business interests are without question protected including their suppliers who need additional protective services.

After having brought everything to a hard boil for a few minutes, serve the remaining politicians or other guests with a taste of this recipe and indeed they too will get in line with, waiting and/or holding their hands out wanting to share in the unlimited profits just to have a piece or slice of the Corporate American Pie.

Self-fulfilling recipe for political corruption and criminal enterprise parties, either serve and feed the beast or starve it to death and end the suffering.

$10 Million Settlement for Exotic Dancers a Not-So-Exotic Outcome in Wage Class Actions

A class of exotic dancers in California and other states have received preliminary court approval of a $10 million settlement of their class action suit in which they claimed that their adult nightclub employers misclassified them as independent contractors.  Trauth v. The Internal Revenue Service, U.S. Department of Labor and many state labor departments also are looking to lay bare employers who they claim are misclassifying their workers.  In an effort to collect more employment tax revenue, over the next three years, the IRS plans to randomly select and audit up to 6,000 businesses that use contractors.  The DOL stated in its 2011-2016 strategic plan that it will partner with the IRS to root out employers who continue to misclassify employees as independent contractors. 
The government efforts likely will arouse the interest of workers eager to seek unpaid minimum wage and overtime pay through class action filings.
The Bottom Line:  An employer can be nakedly exposed to a wage and hour class action unless workers are properly classified.

Senators will be back in their districts between April 18 and April 29.  Now is the time to arrange a meeting with your senators’ staff in their district offices during that time.  Gather allies in your state and schedule meetings to urge your senators to support S. 596 and explain how it will address some of the challenges we face regarding the sex trafficking of children in the U.S.  Also, watch for town halls where senators are taking questions - a great opportunity to raise the issue in a public forum.

A BILL TO BE ENTITLED
AN ACT

relating to the regulation of owners, operators, employees, and independent contractors of sexually oriented businesses to reduce risks to public and occupational health and to prevent human trafficking; providing penalties.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:

SECTION 1.  Subtitle D, Title 13, Occupations Code, is amended by adding Chapter 2158 to read as follows:
CHAPTER 2158.  SEXUALLY ORIENTED BUSINESSES
SUBCHAPTER A.  GENERAL PROVISIONS

Sec. 2158.001.  DEFINITIONS.  In this chapter:
(1)  "Department" means the Department of State Health Services.
(2)  "Executive commissioner" means the executive commissioner of the Health and Human Services Commission.
(3)  "License holder" means a person who holds a license issued under this chapter.
(4)  "Sexually oriented business" has the meaning assigned by Section 243.002, Local Government Code.

Sec. 2158.002.  ADMINISTRATION BY DEPARTMENT OF STATE HEALTH SERVICES.  The department shall administer this chapter.

Sec. 2158.003.  MUNICIPAL AND COUNTY REGULATION.  This chapter is in addition to any municipal or county regulation.  To the extent of a conflict between this chapter and a municipal or county regulation, this chapter controls.
